TERMS & CONDITIONS AGREEMENT


Please stop and take a few minutes to read this agreement carefully. The Customer's rights and obligations in for participating in this program are outlined below. It is the Customer's responsibility, prior to participating in this program, to read this agreement carefully to understand his/her rights and obligations as specified before accepting its terms and conditions.

I agree to the following terms and conditions regarding this offer and the System being traded in under this offer:

  1. I am the sole and proprietary owner free and clear of all encumbrances, of the system bearing the specifications, serial and model number which I have provided ("System").
  2. The System complies with the System Requirements associated with the trade-up offer ("Offer") described above.
  3. The System specifications, serial number and model number I have provided are accurate and complete in all respects.
  4. I am providing the System to Mac Zone and its partners in working order and shall be solely responsible for the arrival condition of the System at Mac Zone's partner facilities.
  5. I am solely responsible for all costs associated with the shipment of the System to (or its return from) Mac Zone's partner facilities.
  6. I am solely responsible for condition of the System including any software or other information stored thereon and agree to indemnify and hold Mac Zones and its partners harmless from and against any liability associated therewith.
  7. Upon receipt and acceptance by Mac Zone or its partners in accordance with the System Requirements and Offer Requirements described above, I hereby transfer all right title and interest in the System to Mac Zone and its partners.
  8. I understand and agree that, upon its receipt and acceptance by Mac Zone or its partners, all data and software on the System will be deleted and the System hard drive sanitized, and that any data or other information stored on the System will thereafter be unrecoverable.
  9. I hereby release Mac Zone and its partners from and against any liability arising out of or related to the System and its shipment and evaluation by Mac Zone or its partners.
  10. I agree to ship the System to the address provided in a confirmation e-mail received from Mac Zone's Lake Forest Facility within 30 days of the shipment date of the new Apple product from Mac Zone to which the Offer applies.
  11. I acknowledge that Mac Zone may reject or limit the quantity of systems to be traded in under the Offer.
  12. I agree that all determinations of Mac Zone or its partners with respect to trade-in and credit value assigned to the System after its inspection will be accepted as final.
